1. Scope of Application

1.1 These General Terms and Conditions (hereinafter "GTC") of S&E Ventures GmbH, operating under "NowDeals" (hereinafter "Agent"), apply to all contracts for the mediation of contracts (hereinafter "Main Contract") concluded by a consumer or entrepreneur (hereinafter "Customer") with the Agent via the Agent's website. The inclusion of the Customer's own terms is hereby objected to, unless otherwise agreed.

1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur within the meaning of these GTC is a natural or legal person or a legally capable partnership that acts in the exercise of its commercial or self-employed professional activity when concluding a legal transaction.

2. Subject of the Contract

The subject of the contract is the mediation of contracts between the Customer and a third-party provider (hereinafter "Provider"), in particular via affiliate links on our website. The Agent redirects the Customer to the Provider's offers via electronic linking. The Agent does not become a party to the Main Contract, does not accept declarations of intent, and does not guarantee the conclusion of the contract. The fulfillment of the Main Contract is solely the responsibility of the Provider. The statutory provisions and the Provider's terms apply to the Main Contract.

3. Conclusion of the Contract

3.1 The Agent provides affiliate links on its website, redirecting the Customer to the Provider's offers. Clicking an affiliate link constitutes a binding offer by the Agent to conclude a mediation contract, which the Customer accepts by clicking.

3.2 The contract text of the mediation is neither stored nor accessible to the Customer after the contract is concluded.

3.3 The contract can be concluded in German and English.

4. Remuneration

The mediation is free of charge for the Customer. Costs arising from the Main Contract are communicated by the Provider and settled directly with the Customer.

5. Performance Disruptions

5.1 The Agent is liable for disruptions in the mediation according to statutory provisions.

5.2 The Agent is not liable for disruptions in the Main Contract. Claims must be asserted directly against the Provider.

6. Applicable Law

The law of the Federal Republic of Germany applies to all legal relationships, provided that consumers are not deprived of mandatory protections of their country of residence.

7. Alternative Dispute Resolution

The Agent is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
